Episode 70: Supreme Court Review June 2024: Guns, Confrontation Clause & More

Grab a glass of wine and join our legal team as we discuss the Supreme Court's 2024 case decisions! This week, find out all about the cases the Supreme Court decided on June 20, 2024 and June 21, 2024. In particular, we focus on the 2nd Amendment ruling of United States v. Rahimi, 602 U.S. ____ (2024), and on the Confrontation Clause case of Smith v. Arizona, 602 U.S. ____ (2024).

In United States v. Rahimi, SCOTUS upheld the government's right temporarily to take away firearms from someone who is subjected to a protective order and from someone who has been convicted of an act of domestic violence.

In Smith v. Arizona, a CSI expert was not available to testify against the defendant regarding her laboratory findings, so another expert was called to testify about her opinions instead. SCOTUS held that the 6th Amendment's Confrontation Clause prohibits experts from testifying about another expert's results for the truth of the matter, because the defendant could not credibly cross examine the witness against him - the original lab tech.

We also address the immigration case of Department of State v. Munoz, 602 U.S. _____ (2024), through which SCOTUS declined to question or overturn the findings of the U.S. Citizenship and Immigration Service to refuse reentry of a foreign immigrant.

Finally, we wrap the show up with a lively discussion on Louisiana's recent law requiring the 10 Commandments be posted in all of its schools and on Aileen Cannon's strange request for both parties in the Trump documents case to argue whether a government entity had the right to appoint Jack Smith as Special Prosecutor against Donald Trump.
