This episode of Virtual Water Cooler Chat features Jessica Kaiser on her path to becoming a patent attorney.

Jessica graduated from the Colorado School of Mines with a degree in metallurgical and materials engineering. She worked as an engineer for 5 years, primarily in the oil and gas industry, before going to law school.

After law school, Jessica clerked at both the district court level and at the Court of Appeals for the Federal Circuit. She was an associate and partner at a large international law firm where she focused her practice on patent litigation before district courts and the International Trade Commission. Then, Jessica went in-house to the Office of General Counsel at the Federal Circuit before joining the Patent Trial and Appeal Board as an administrative patent judge.

Jessica was an APJ and Lead APJ for over seven years. During that time, she managed and decided numerous cases before the PTAB in AIA trials (both inter partes reviews and post-grant reviews) and ex parte appeals during the original prosecution of patents. Jessica exercised her leadership skills and worked closely with her peers with the USPTO and PTAB leadership in developing and implementing PTAB reforms, including agency rulemaking, a pilot program for motions to amend patent claims during AIA trials, PTAB statistics, and remote hearing operations.

Jessica returned to private practice in March 2022 at Arnold & Porter Kaye Scholer LLP, where she advises clients in complex intellectual property disputes. Her practice primarily focuses on district court patent litigation and proceedings before the PTAB.

Jessica just celebrated her 26th wedding anniversary with her husband, has two wonderful kids aged 13 and 10, and the world’s cuddliest rescue dog.
